1. Application field

The present General Sales Conditions detailed below (herein referred to as "general conditions") exclusively determine the contractual relations between every customer using the Bioage website (herein referred to as " user ") and COSBRAND LDA, with share capital of 25,000 euros, whose registered office is located at Rua Hintze Ribeiro, 74, Aveiro, Portugal. The company is registered under NIPC PT513024751 (herein referred to as « COSBRAND »). 

The general conditions of sale are the only ones to be applied and they replace all other conditions, except for prior express agreement in writing. COSBRAND may from time to time modify certain provisions of its general conditions, and this must also be reread at each visit to the Bioage website (herein designated " Site "). We consider that when the order is validated, the customer is automatically accepting our general conditions of sale.

By connecting to the site, the customer undertakes to respect the General Conditions as well as the Conditions of Use.

Always carefully read the instructions for use of each product, and in case of doubt, use the contact form or our chat before any use.

The photographs that illustrate the products do not enter into the contractual field and do not replace any commitment on the part of COSBRAND. On the other hand, with regard to technical sheets and product descriptions of our partners or suppliers, COSBRAND declines all responsibility for the validity of their content.

The accessories that come in the packs sold by COSBRAND may be accessories from compatible brands and not necessarily from the brands of the equipment manufacturers.

  1. Price

The sales prices indicated on the website are in Euros, with taxes and fees included. Shipping costs are borne by the customer and are charged at the end of the order, depending on the products selected , their weight and destination.

The COSBRAND reserves the right to change prices at any time, however try to apply the tariffs in force that were indicated on the site at the time the customer making the request.

Please be advised that if the price indicated is incorrect and manifestly insignificant, regardless of its cause (computer bug, manual error, technical error, etc.), the order will be canceled, even if it has already been confirmed and paid.

The platform is configured with the most recent legislation in terms of application of VAT rates, but in case the billing address and delivery address are in different countries, there may be an adjustment of the VAT amount, by virtue of the applicable legislation. in force.

  1. Availability

COSBRAND respects the deadlines for sending an order as long as there is stock availability.

In the event that one of the ordered products is not available in stock, COSBRAND will contact the customer by email or telephone within a maximum period of 10 days from the date of the order, in order to inform the new delivery period. of product.

COSBRAND asks the customer to choose, instead of the unavailable product, a product with equivalent quality and price. In case of refusal by the customer, COSBRAND will refund the total value of the product.

  1. Delivery modes

Products purchased on the Site are delivered to mainland Portugal and the Islands via CTT, a carrier with an Express Service or at COSBRAND's headquarters. The COSBRAND not perform OFF separated. The order will be delivered to the address specified by the customer at the time of purchase.
The contribution for transport, as it is added to the price of the products purchased, will be calculated automatically by the system. In case of non-receipt of the order within the indicated deadlines, an investigation will be made with the carrier, and it may take a few days. The Customer must contact the COSBRAND Customer Service and during this period no refund can be made , as the loss of the order will have to be verified and confirmed.

The customer will have 24 hours after receiving the order to complain to our Customer Service by telephone 234 042 021 about any anomaly with the order. COSBRAND is not responsible for any problems arising from transport. COSBRAND will be obliged to refuse any request for a refund or replacement (right of withdrawal) for products that present external defects and that have not been filed a claim within 24 hours. The right of withdrawal remains valid for cases of technical problems that are detected by the customer after delivery and in accordance with the terms provided by law. What to do upon delivery: Check if the packaging is in perfect condition. Check that the product complies with the order made and that it has no visible defects. Shipping costs are borne by the customer and are automatically calculated before the user finalizes the order, taking into account the products and their weights or volumetric weights.  

When finalizing the order, the customer accepts the values ​​previously calculated and presented for the shipping costs.

Prices with VAT included at the statutory rate

  1. Delivery times

After making the payment, the order will be shipped within 48 working hours.

Delivery times are indicative depending on the delivery mode chosen by the customer, and therefore, to be considered valid when there are no physical or structural impediments (for example: incorrect addresses or force majeure setbacks).

COSBRAND has chosen to secure its payments with partners who can guarantee that they are secure by encrypting the connection for network transactions.

The name of our partners may appear on the statement from your bank account.

  • Payment via Bank Transfer

The customer has a period of 2 hours, after placing the order, to proceed with the payment. Method only available for transactions outside Portugal. In the case of non-SEPA Bank Transfer, the customer must transfer the value of the order plus €20.

Please note that if the security officer or our security department suspects fraud, COSBRAND reserves the right to cancel the transaction .

    • The customer has a period of 36 hours, after placing the order, to proceed with payment at the ATM Network (CA)

Within a maximum period of 14 days after receiving the order, the customer has the right to terminate the contract.
The cost of shipping the product for return will be the responsibility of the customer.
The customer may be held responsible for the depreciation of the asset, if the manipulation carried out to inspect the nature, characteristics and functioning of the asset exceeds the manipulation that is usually permitted in a commercial establishment.

Products excluded from the right of legal withdrawal:

  • Incomplete, damaged or used products by the customer; 
  • Supply of goods made to customer specifications or manifestly customized;  
  • Supply of sealed goods not subject to return, for health or hygiene protection reasons when opened after delivery.  

In case of exercising the right of withdrawal, COSBRAND will do its utmost to reimburse the customer quickly (by the same method of payment), noting, however, that this period will depend on the technical evaluations that will be carried out on the material, with a maximum duration of 15 days (counted upon arrival at COSBRAND).

The warranty does not apply to problems resulting from causes external to the product (for example: accident, shock, lightning, a power failure...), from use or installation not in accordance with the manufacturer's specifications, or from use detrimental to good conservation of product.

  1. Devolution

To return an item*, the customer must contact our customer service, using the telephone number or email in the "contact us" tab. Shipping fees are borne by the customer (the product travels under the customer's responsibility). For the period covered by the warranty, the customer must return it directly to COSBRAND's After-Sales Service (SPV). After Sales Service Address: Rua Hintze Ribeiro, 74 3800-359 Aveiro - Portugal 
(*) The deadline for returning items is 14 days after receipt with the presentation of the purchase document.

 

  1. Product warranty

Products for sale on the website are covered by various types of commercial warranties set out below. The subscription by the customer of these commercial guarantees does not preclude the application of the legal guarantee of conformity in the following legal conditions for any material sold by COSBRAND on the website, whether new or of occasion.

By applying the legal guarantee of compliance, COSBRAND undertakes to deliver your order in accordance with the established sales contract and correct any compliance defects found at the time of delivery.

In order to comply with the contract, the products must:
1) correspond to the description on the website during the order;
2) be recommended for the use for which products of the same type are normally intended or any other type of special use sought by the customer, who has been informed by COSBRAND prior to placing the order and that this has been formally accepted;
3) present the usual quality and features of a product of the same type expected by any consumer, taking into account the nature of the product and the characteristics described on the website.

 

Commercial guarantees provided by the product manufacturers (defective product):

In addition to legal warranties, some goods sold on the website benefit from the manufacturer's warranty, whose coverage and duration vary depending on the products and brands.

In general, manufacturers' warranties do not cover abnormal or non-conforming use of the products.

Therefore, we recommend that you carefully read the product labels.

In any case, COSBRAND is not responsible for the non-application of the warranty by the manufacturer for the reason described above.

12.2 Disputes

For the resolution of any and all disputes arising from the interpretation or execution of these General Conditions, the court at COSBRAND's Headquarters will be competent.

12.3 Liability

COSBRAND is not responsible for delays or contractual non-compliance due to force majeure, disturbance, total or partial strike, postal services and means of transport or communication, flood, fire or war. COSBRAND is not responsible for any indirect damage , loss of operation, loss of benefit, loss of opportunity, damage or fees that may result from the purchase of any product presented on the website.

COSBRAND does not assume any responsibility for misuse or misuse, nor for wear resulting from the normal use of the products it sells.

The application and use of the products sold are the sole responsibility of the customer, who should carefully read the respective instructions for use, application and operation. The customer must verify that the product purchased corresponds to the one ordered. In accordance with Law nº24/96 of 31st of July , and Decree-Law nº 67/2003, of 08th of April.

  1. Comment, criticism, communication

Opinions published by COSBRAND users are monitored and moderated by the marketing team. Whenever a text sent violates the law and ethics (abusive advertising, defamatory purposes, insults, comments out of context, etc. ) COSBRAND reserves the right to refuse or modify it.

  1. Intellectual property

All content on the Bioage Site (illustrations, texts, titles, brands, images, videos) is the property of COSBRAND, its co-contractors or partners. The partial or total reproduction of the content through any procedure and in any medium is subject to prior and express authorization from COSBRAND. All information, content, documents and software offered by our services are protected by Portuguese and international legislation, with regard to intellectual property and copyright. COSBRAND cannot authorize the copying, presentation or distribution of contents in which you do not have the intellectual property right. Any fraudulent use of rights obtained by third parties constitutes a counterfeiting offense , severely sanctioned by the Intellectual Property Code. COSBRAND will not be responsible, in any way, for the violation of a user of rights obtained by third parties and perpetrated by the latter's activities on the website.
